Termination of employment contract under art. 53 of the Labor Code with a protected employee, part 3

In the last part of the discussion on termination of employment contract with a protected employee, we will briefly discuss the termination of cooperation with a member of the works council.

In accordance with art. 17 of the Act of 7 April 2006 on informing employees and conducting consultations with them (Journal of Laws No. 79, item 550), termination and termination of employment relationship with an employee who is a member of the works council requires the employer to obtain the consent of the works council.

The employer should therefore apply to the works council for consent to waive the protection covering its member before handing the employee a document containing the termination or termination of the employment contract.
