Due to the upcoming parliamentary elections in Poland, many employees will take part in the work of the electoral commission. Clients of the PRWT accounting office in Warsaw and Krakow wonder how such employee absence should be recorded and what it involves?
The answer to the above question should be found in the Polish Electoral Code. Art. 154 par. 4 of this legal act, indicates what rights an employee is entitled to in connection with the performance of the tasks of a member of a district or territorial electoral commission. The employee has the right to:
– leave from work while retaining the right to ZUS benefits and rights from the employment relationship on the day of voting and counting of votes, as well as on the day following the day on which the counting of votes was completed;
– leave from work with retaining the right to benefits from ZUS and employment relationship rights, but excluding the right to remuneration for up to 5 days.
An employee who wants to take advantage of the above-mentioned leave from work is obliged to submit an appropriate application in this respect to the employer at least 3 days before the planned absence from work.
