Working on Sundays and public holidays is only permitted in certain cases. The most common solution used by employers to provide work on Sundays and public holidays is the introduction of shift work (Art. 151¹⁰ point 3 of the Polish Labor Code).

There are situations when a holiday falls on a Sunday. Such a situation took place, for example, on August 15, 2021 and will take place on December 26, 2021. Customers of our PRWT accounting office then ask the question of how to settle the working time of people working on these days?

Compensation for work on Sunday, which is additionally a holiday:

December 26 this year, in addition to being on a Sunday, is also a holiday (according to the provisions of labor law, the regulations regarding work on Sunday apply to work on a holiday falling on Sunday).

If work is performed on a Sunday, the employer is obliged to provide the employee with another day off during the 6 calendar days preceding or following such Sunday.

Therefore, if employees work on Sunday, December 26, they should be given another day off in the period of 6 days preceding or following Sunday, December 26. You should agree with these employees on the day on which they will be taken off for work on December 26.

If the employee is not able to take a day off in the indicated period of 6 days, the employee is entitled to a day off until the end of the settlement period. If at this time it would also be impossible to grant a Sunday holiday, the employee is entitled to additional remuneration for each hour of work on Sunday, calculated in accordance with Art. 151¹¹ of the Labor Code.
