Establishment of a limited liability company in Poland by a foreigner

Citizens of the European Union can freely conduct business activity in Poland, because the same regulations apply to them as to Polish citizens. The fastest way to set up a company is to register it via the S24 system. However, it should be remembered that documents submitted to the National Court Register via the S24 system must be signed with a trusted profile or a qualified signature purchased from a supplier of qualified certificates recommended by the Polish Ministry of Justice.
While the procedure of obtaining a trusted profile for a Polish citizen is not complicated and lengthy, the process is much longer for a foreigner. This is due to the fact that in order to obtain a trusted profile it is necessary to have a PESEL number. Each Pole receives this number at birth. A foreigner has to obtain it only by submitting an appropriate application to the appropriate office. Only after obtaining a PESEL number a foreigner can start trying to obtain a trusted profile.

A foreigner who does not have a qualified signature recognized by the Polish Ministry of Justice will have to obtain a PESEL number before starting business in Poland.
