Changing the regulations on employee documentation

In connection with the introduction of the provisions on sobriety control, the provisions of the Regulation of the Minister of Labor and Social Policy of December 10, 2018 on employee documentation have also changed. Clients of our PRWT accounting office ask what this change is all about and how it should be introduced.

In par. 3 of the Ordinance, a new point 5 has been added, specifying that a new part “E” should be included in the personnel files of employees, in which documents related to the employee’s sobriety test or the control of the presence of substances similar to alcohol in his body. The new regulations entered into force on March 21, 2023. The need to create a new part of personal files applies to employers who have introduced the possibility of conducting sobriety checks in their workplaces and should be created successively as documents related to the employee sobriety testing procedure are created.
