A company car and psychotests

The question of whether an employee using a company car (especially occasionally) is required to undergo psychological tests as one of the examinations allowing to perform work raises doubts among employers – clients of our PRWT accounting office.

In the referral for medical examinations, the employer should provide the most detailed description of the working conditions of the employee in the position held (including whether the employee uses the job / it may be necessary to use a company car). It is important because, on the basis of this information, the doctor decides which tests should be referred to the employee (including whether the employee should undergo psychological tests for drivers). Of course, two situations should be distinguished here:

  1. When the employer, at the time of issuing the referral for the employee’s medical examinations, has knowledge or provides for the employee to be able to use a company car while performing his official duties (then such information is included in the referral for the employee’s medical examinations).
  2. When the employer, at the time of issuing the referral for the employee’s medical examination, does not anticipate that the employee may occasionally use the company car in the future (then such information was not included in the examination referral for obvious reasons). It seems that in such a situation the employer cannot be accused of not including relevant information in the referral for research. The assessment will, for certain, be case-specific.

The recommended solution for employers is to indicate in the referral of employees for medical examinations (for whom we can anticipate the need to use a company car in connection with the duties performed) information that the employee may need to use a company car occasionally. Then the burden of responsibility for the decision on the need to refer the employee to psychophysical examinations in connection with driving a car rests with the occupational medicine doctor, who directs the employee to appropriate examinations.
