Can an employee with a slight degree of disability work at night?

As you know, employing a disabled person requires compliance with additional regulations contained in the Polish Act of 27 August 1997 on vocational and social rehabilitation and employment of disabled persons (hereinafter the “Act”). Pursuant to the aforementioned Act, disabled persons may not be employed at night or overtime (Article 15 (3)). However, clients of our PRWT accounting office ask if there is any possibility for disabled people to be able to work at night?

The answer to the above question can be found in Art. 16 of the Act. It is possible for an employee with a certified degree of disability to work at night or overtime, but under certain conditions. Firstly, the application for consent to perform such work should be submitted by the employee himself, and secondly, the consent must be given by the doctor who carries out preventive examinations of employees or the doctor who takes care of the employee.
