In the near future, there will be a situation in which there will be public holidays on Saturday (December 25, 2021 and January 1, 2022). Clients of our PRWT accounting office may have several dilemmas related to this situation.
Does the occurrence of holiday in Saturday cause any rights for employees?
Yes, in accordance with Art. 130 par. 2 of the Polish Labor Code, each holiday occurring in the settlement period and falling on a day other than Sunday reduces the working time by 8 hours.
Consequently, in practice, the employee has the right to take a day off in exchange for a public holiday in Saturday. Of course, the day off (8 working hours) applies to full-time employees. Part-time employees have a proportionally reduced working time.
How can an employee pick up a day off?
In order to collect a day off in exchange for a public holiday Saturday, the employee should submit an appropriate application. It should be remembered that the final decision as to the date of using the employee’s day off is made by the employer, who, if possible, should agree to the date indicated by the employee.
