What formalities must be completed before starting work?

Before starting work for a new employer, it is necessary to obtain a certificate from an occupational physician, allowing the employee to start work in the position offered by the employer. If our new employee has a valid certificate from the previous employer, the working conditions in the new position correspond to the working conditions for which the certificate was issued, and the break in employment lasts less than 30 days, the employee may use a certificate from the previous employer. Such a certificate must be available before starting work. The employer is also responsible for conducting occupational health and safety training for the employee and on-the-job training.

What documents should the employee provide to the new employer?

When starting work, the employee should present the employer with certificates confirming the course of education and employment certificates received from previous places of employment. These documents will allow for the correct determination of the employee’s length of service and the vacation leave they are entitled to.

What documents should the new employer provide to the employee?

The new employer should provide the employee they employ with a number of documents that will enable them to make correct notifications to the social insurance system and correctly calculate income tax advances due on the employee’s remuneration. These documents are:

– a personal questionnaire for the employee,

– an application to register family members for health insurance (if applicable),

– a statement on the use of rights related to parenthood (if applicable),

– a PIT-2 form,

– a statement on the tax base from the previous place of work for the calendar year in which the employee starts working for the new employer,

– a statement on the basis of pension and disability contributions (similarly to the statement on the tax base).

The employer should also provide the employee with:

– information on the terms of employment, prepared in accordance with the provisions of Article 29 § 3 of the Labor Code,

– notice on the system and distribution of working time and the settlement period,

– information on the creation/non-creation of the Company Social Benefits Fund,

– information on the payment/non-payment of holiday benefits,

– information clause on the processing of personal data,

– information on equal treatment in employment

– all types of internal regulations applicable in the workplace.

What documents should be attached to the contract of mandate?

The most important document for the principal that should be completed by the contractor is the declaration to the contract of mandate and the PIT-2 form. These documents will enable the contractor to correctly register for social insurance and to properly take into account tax reliefs and calculate income tax advances.
